HUD DOJ Joint Statement on Reasonable Accommodations Under the Fair Housing Act

The Department of Justice (“DOJ”) and the Department of Housing and Urban Development (“HUD”) are jointly responsible for enforcing the Fair Housing Act, which prohibits discrimination in housing on the basis of race, color, religion, sex, national origin, familial status, and disability. One type of disability discrimination is the refusal to make reasonable accommodations in rules, policies, practices, or services when such accommodations may be necessary to afford a person with a disability the equal opportunity to use and enjoy a dwelling. This Joint Statement prepared by the DOJ and HUD is an FAQ assists with various questions and scenarios when dealing with reasonable accommodations under the Fair Housing Act.
